Terms of Service
These terms govern your use of Coldoutbound, provided by Staaro OÜ (registry code 17561530, Looduse tn 4, 44314 Rakvere, Estonia) ("we"). By creating an account you accept them for yourself and for the organization you sign up.
1. The service
Coldoutbound sends email sequences from mailboxes you connect, tracks replies, bounces and unsubscribes, and stops a sequence for people who reply or opt out. Email leaves from your own mailboxes and your own email provider, under their terms as well as these.
The service is free. We may add paid features later; anything that stays free today will not start costing money without notice.
2. Your account
You must be at least 18 and use Coldoutbound for business. Keep your login and API keys secret; you are responsible for what is done with them. Give your AI agents a read-only key when they only need to report.
3. Acceptable use
You may only send email you are allowed to send under the law that applies to you and to each recipient, including the GDPR, national e-privacy and marketing rules (some countries require prior consent even for business email) and, in the US, CAN-SPAM.
Send to business addresses of people you have a legitimate reason to contact. Do not send to purchased lists of consumers, to addresses scraped against a site's terms, or to anyone who has opted out.
Identify yourself truthfully, honor opt-outs (Coldoutbound stops mailing anyone who replies "unsubscribe" or uses their mail client's Unsubscribe button, and you must not work around that), and keep bounce and complaint rates low.
Never use Coldoutbound for phishing, malware, impersonation, deceptive content, or anything illegal.
We pause mailboxes and campaigns automatically when bounces or spam rejections spike, and we may suspend or close an account that breaks these rules, with or without notice where the abuse warrants it.
4. Your data and your mailboxes
You own your leads, sequences and email. For the personal data in them you are the controller and we are your processor, under the Data Processing Agreement, which is part of these terms.
Mailbox passwords and sign-in tokens are stored encrypted and used only to send and read the mail of the campaigns you run.
5. Aggregated and company-level data
To run and improve the service we derive statistics from how mail fares: for example which email provider or security gateway a recipient domain uses, a domain's address format, and delivery, reply and bounce rates by provider, country and sequence step.
These are about domains and companies, or are aggregated across many customers. They never contain an email address, a person's name or your lead lists, and no figure is shown unless enough organizations stand behind it that no single customer can be identified. We may use them for benchmarks inside the product and may offer company-level data and aggregated statistics to others.
We do not sell personal data, your lead lists or your email content.
6. Availability and warranties
We work to keep Coldoutbound running and your data safe, but provide the free service as it is, without warranties of uninterrupted availability or fitness for a particular purpose. Inbox placement depends on your mailboxes, domains, content and recipients, which we do not control.
7. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost revenue or lost data, and our total liability for the free service is limited to EUR 100. Nothing here limits liability that cannot be limited by law.
You are responsible for the email you send and will cover our reasonable costs if a third party claims against us because of it.
8. Ending
You can close your account at any time. We may end the service with 30 days' notice, or at once for a breach of section 3. When an account closes we delete its data within 30 days, except where the law requires us to keep it; aggregated statistics already derived (section 5) are not personal data and stay.
9. Changes and law
We will tell you by email or in the app before material changes take effect. These terms are governed by [governing law and courts — to be confirmed].
